Welcome to Nanobyte Hosting. By signing up for or using our services, you agree to be bound by the following Terms of Service ("Terms," "Agreement"). If you do not agree to these terms, you must strictly stop using our services.
1. Overview
These Terms constitute a legal agreement between Nanobyte Hosting ("we," "us," "our," or "Company") and you ("Customer," "User," or "Client"). These terms govern your use of our Web Hosting, VPS Hosting, and Domain Registration services.
2. Account Eligibility & Security
Eligibility: You must be at least 18 years of age or the legal age of majority in your jurisdiction to create an account.
Accuracy: You agree to provide true, accurate, and current information during registration (including a valid email address).
Security: You are responsible for maintaining the confidentiality of your login credentials. Nanobyte Hosting is not liable for any loss or damage arising from your failure to protect your account security.
3. Services Provided
A. Web Hosting (Shared)
Resource Usage: Accounts are subject to resource limits (CPU, RAM, Inodes) as detailed in your specific plan. Excessive usage that impacts other users may result in temporary suspension or a requirement to upgrade.
Unlimited Policy: If a plan is advertised as "Unlimited," it is subject to our Fair Use Policy. It is intended for normal web hosting usage, not for file storage, archiving, or backup repositories.
B. VPS Hosting (Virtual Private Server)
Self-Managed: Unless otherwise stated, VPS plans are self-managed. You are responsible for the security, updates, and maintenance of the operating system and software installed on your VPS.
Root Access: You accept full responsibility for any changes made using root/administrative access. We reserve the right to suspend instances that are targeted by (or are the source of) DDoS attacks or malicious activity.
C. Domain Hosting & Registration
ICANN Rules: You agree to abide by the rules and regulations set forth by ICANN and the respective domain registrars.
Renewal: It is solely your responsibility to renew your domain before the expiration date. Nanobyte Hosting is not liable for domains lost due to failed renewals or payment failures.
Ownership: You retain ownership of domains registered through us, provided all fees are paid.
4. Payments, Billing, and Refunds
- Billing Cycle: Services are billed in advance on a recurring basis (Monthly, Annually, etc.).
- Late Payments: Invoices not paid by the due date may result in service suspension. Data may be terminated (deleted) if invoices remain unpaid for more than 14 days.
- Refund Policy: We offer a 30-Day Money-Back Guarantee for Web Hosting/Shared Hosting only.
- Exclusions: Domain registrations, VPS fees, software licenses (e.g., cPanel), and setup fees are non-refundable.
5. Acceptable Use Policy (AUP)
You agree not to use Nanobyte Hosting services for:
- Sending unsolicited bulk email (SPAM).
- Hosting phishing sites, malware, or viruses.
- Hosting illegal content, including child exploitation material (CSAM).
- Copyright infringement (DMCA violations).
- Running resource-intensive scripts (e.g., crypto-mining) on shared environments.
Violation of this section is grounds for immediate termination without refund.
6. Backups and Data Loss
Your Responsibility: While we may perform courtesy system backups, you are solely responsible for maintaining your own backups of your website and data.
No Liability: Nanobyte Hosting accepts no liability for data loss, corruption, or the failure to restore data, regardless of the cause (including hardware failure or human error).
7. Uptime Guarantee (SLA)
We strive for a 99.9% Network Uptime. If we fail to meet this guarantee in a given month, you may be eligible for a service credit calculated as a percentage of your monthly fee. This excludes scheduled maintenance or events beyond our reasonable control (Force Majeure).
8. Limitation of Liability
To the maximum extent permitted by law, Nanobyte Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of our services.
9. Termination
By Client: You may cancel your service at any time via the client portal.
By Company: We reserve the right to terminate your account immediately if you violate these Terms, specifically the Acceptable Use Policy.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of Jordan, without regard to its conflict of law provisions.
